Terms of Service

1. Acknowledgment

These Terms of Service ("Terms") govern your use of FanToBuy, available at fantobuy.com (the "Service"). By creating an account or purchasing content through the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

FanToBuy lets creators ("Sellers") upload digital content — photos and videos — and sell access to it through payment links. Buyers pay through our payment processor and receive time-limited download links. FanToBuy is a platform: the content sold through it is created and owned by Sellers, not by FanToBuy.

3. Accounts

You must be at least 18 years old to create an account or make a purchase. You are responsible for the accuracy of your account details and for keeping your password confidential. You are responsible for all activity that happens under your account, including activity by team members ("chatters") you invite.

4. Content rules

Sellers may only upload content they created themselves or hold the necessary rights to. Content must comply with our Acceptable Use Policy. Explicit adult content is not permitted. Content may be reviewed before publication, and we may reject or remove content that violates these Terms at any time.

5. Fees, earnings and payouts

FanToBuy charges a platform fee on each successful sale, as described in Earnings & Payouts. The remainder is credited to the Seller's wallet. Payouts require identity verification and are subject to a minimum amount. FanToBuy issues self-billing invoices on the Seller's behalf.

6. Purchases and refunds

Purchases give the buyer a personal, non-transferable licence to download the purchased content for personal use. Because content is delivered digitally and immediately, refunds are limited as described in the Refund Policy. Buyers may not resell, republish or redistribute purchased content.

7. Intellectual property

Sellers retain all rights to their content. By uploading, a Seller grants FanToBuy a limited licence to store, process (including generating blurred previews) and deliver the content solely to operate the Service. The FanToBuy name, design and software remain the property of FanToBuy.

8. Copyright complaints

If you believe content on FanToBuy infringes your rights or was shared without your consent, follow the procedure in Complaints & Content Removal. We remove infringing content and may terminate the accounts of repeat infringers.

9. Prohibited use

You may not use the Service for anything unlawful, attempt to bypass payment or access controls, scrape or resell the Service, upload malware, or abuse the affiliate or referral program. We may suspend or terminate accounts that do.

10. Termination

You can stop using the Service at any time. We may suspend or terminate an account that violates these Terms, presents a fraud or legal risk, or is required to be closed by our payment processor. Outstanding legitimate balances are paid out after review, subject to applicable law.

11. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, FanToBuy is not liable for indirect or consequential damages, loss of profits, or loss of data. Our total liability for any claim is limited to the fees we received from you in the six months before the claim arose.

12. Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

13. Changes

We may update these Terms from time to time. The current version is always available at this page, with the date of the last change at the top. Continued use of the Service after a change means you accept the updated Terms.
